11. WHAT REGULATORY CONTROLS ARE IN PLACE?

Midas Contracts & Investment
No contracts or investment whatsoever shall be entered into until all due diligence is completed to the total satisfaction of each of the proposed participating mobile networks, their individual terms and conditions, and also those of their existing (and any future-proposed) associate partners, and until all aspects of the proposed Midas Consortium shall be in full statutory compliance and accordance with The European Commission and any other relevant regulatory bodies.

The European Commission and other Regulatory Controls
All matters shall have to comply with The European Commission, The European Regulators Group,  The European Mobile Broadcasting Council, Ofcom, The Data Protection Act, The Office of Fair Trading, The Financial Services Authority, Der Bundesdatenschutzgesetz in Germany, Le Commission Nationale de l'Informatique et des Libertes (CNIL) in France and such parallel institutions in countries where the Midas Consortium may operate.

Consumer Protection Regulations

New EU regulations are now in force to protect the consumer from illicit advertising and faulty goods including unscrupulous marketing tactics. It will also prevent ads that are explicitly aimed to minors of a sexual or depraved nature.  A Consumer Protection Regulatory panel shall have the right to censor any internet transmission including certain advertisers or sponsors that may propogate, incite or instruct anti-religious or terrorist assemblies.

What's in it for each Government in each Midas host-territory?
Governments can now greatly benefit from not having any ID cards, Passports, banknotes and coinage. This will save billions of dollars due to all relevant, personal information, re bank accounts, National Insurance, etc., shall be embedded in each mobile-phone by an encrypted, algorithem system that is supported by one's DNA/Biometric personal code. This totally prevents theft or fraud and restores public and private confidence with Data Storage & Transmission Systems.

Censorship of Content

There shall be strict supervision and surveillance over Mobile TV content and advertising. There shall be no sponsorship or ads for cigarettes or drugs. In all matters concerning advertising and content moral standards, the decision of The European Commission's Regulatory Board shall be final.

There shall be no breach of any statutory regulations, nor conflict of interest between subscribers and their resident networks. Mobile phone groups shall not themselves divulge, sell or share any subscribers’ contact details, purchasing preferences, financial status or any potentially libellous information to any third-party whatsoever.

Each participating telecom group shall retain and maintain its own legal and financial framework; no debt liability, nor confidential material, or any litigious matter shall be shared or entered into by any other mobile phone group in the Midas Consortium.

Midas corporate governance wishes to associate with existing suppliers, and to be in harmony with any other existing corporate, contractual obligations such as legal and auditing bodies.

Policy control and all legal and financial disciplines shall be exercised by each of the proposed mobile phone groups.

The Midas Consortium is a multinational, non-racial and non-political group, employing the best standards of corporate governance, ethics and principle.

*Any mention of any corporate group does not imply any acceptance, obligation or contractual  association with Harry Brooks or the Midas Board, until a formal letter of intent is constructed relevant to their specific terms and conditions.

 

Midas Corporate Governance Policies
*We are expressly observing that there shall be no conflict of interest or liability between any party, and that this proposed association of subscribers shall only strengthen each groups' activities and shareholder-value.

Exemption

There shall be no liability whatsoever upon any corporate group or shareholders within the proposed Midas Consortium concerning any transactions between Tenant Companies and their customers. Each corporate group has its own articles of association and shall perform accordingly.

Caveat Emptor

Each Tenant Company has a duty of care to any buyer and may be liable for any faulty goods or for non-delivery. Advertising shall comply with the Trades Description Act. Notwithstanding this caveat emptor applies unless the Tenant Company is proven negligent, deficient or guilty of misrepresentation.

In all cases where credit/debit cards are employed then the buyer abides by the specific terms and conditions pertinent to each credit card company.

In all transactions neither The Midas Consortium nor The Midas Board (or any appointed partners) shall be culpable or liable of any matter whatsoever.

*No corporate contracts shall be entered into, nor any investment proposals considered, until further due diligence is completed, and until we have further consolidated our position and established letters of intent amongst the proposed mobile phone groups.

*We are totally impartial with all our exploratory talks and correspondence with each of the proposed mobile-phone networks. We respect their wishes for confidentiality until such time as letters of intent are constructed subject to their individual terms and conditions.

*We are also collating precise and detailed technical capabilities from each of the proposed mobile-phone networks' infrastructure. We also wish to discuss a proposed network-sharing blueprint in order to develop and facilitate a pan-European network system that would be advantageous and cost-effective to each mobile network concerned.
